Business owners suing city of Petal, mayor for breach of contract – Mississippi News

PETAL – Less than two months after signing a lease agreement to allow Eric Barnes and Heather Barnes to use one of its buildings listed for sale, the city of Petal terminated that lease and sold the property to somebody else.

Now the couple is suing the city and Mayor Hal Marx, claiming breach of contract.

Eric Barnes was operating Complete Automotive at the 144 W. Central Ave. location with Kevin Haddox. Heather Barnes later opened Superior Vape next door in a building also owned by the city. 

They also invested money into improvements and repairs and brought in equipment to use at the businesses.

However, they were forced to sell some of the equipment at a loss “and abandon the building which they had spent time and money restoring and repairing which they were lawfully entitled to possess pursuant to the contract,” according to the lawsuit.
